How Long Will My Car Accident Case Take?

A question that I get asked a lot is “how long will my car accident case take ?”  The short answer is that it depends.  When it comes to most injury cases, a lawyer should never settle your case until you have reached MMI (maximum medical improvement). In other words, you reach a state where your condition cannot be improved any further or when a treatment plateau in a your healing process is reached. Essentially, you are fully healed and no longer need to seek treatment for the injury.

Once you have reached MMI, your lawyer should begin to assemble all your medical records, medical bills and damages into a Demand Package. That is then sent to the insurance company or party at fault and negotiations to settle begin.  If it has been a considerable amount of time since you have reached MMI (your treatment ended) and your lawyer has not begun the settlement negotiations, it may be time to seek out another lawyer. A lawyer is obligated to keep you informed of the settlement negotiations.

If your lawyer is unable to settle your claim with the at fault party/insurance company, then a lawsuit will be necessary to compensate you for your damages.
