Uber is one of the fastest growing ride sharing apps. The convenience of Uber compared to that of conventional taxis is almost certainly the reason for the explosive growth. Uber drivers can even now drop off and pick up from airports. I myself have used Uber on several occasions. It is a great service. Taxis can sometimes take hours to show up and sometimes they don’t even show up at all. With the Uber app, your ride is there in minutes. All of this is great, but what happens if you are involved in a car accident while riding in an Uber car? Who is responsible to pay for your injuries?
Uber drivers use their own personal cars; they are considered independent contractor and not employees of Uber. They can pick up riders at their convenience by simply turning on and off their app. Many Uber drivers’ personal insurance policies exclude “driving for profit.” Meaning the insurance policy will not cover those injured if it was a paid for ride.
Recently Uber has added a one million dollar insurance policy to cover each one of their Uber drivers while they transport Uber passengers. This insurance policy has three parts. Whether or not you are covered depends on what the Uber driver was doing at the time of the accident.
Scenario 1: The Uber driver is using his vehicle for personal purposes and not picking up passengers. In this scenario, the individual Uber driver’s insurance policy would be liable for your injuries.
Scenario 2: The Uber driver has signed into his/her app, is looking for passengers, but has not picked a passenger up yet. In this scenario, the primary coverage would come from the individual Uber driver’s insurance policy. Additionally, Uber provides contingent liability coverage of $50,000 per injury (up to $100,000) and up to $25,000 in property damage. This is only available if the individual Uber driver’s insurance policy does not cover everything.
Scenario 3: The Uber driver is carrying a paying Uber passenger. In this scenario, Uber’s one million dollar insurance policy covers the accident. Additionally there is a one million dollar policy for those drivers that are uninsured/underinsured.
Just because there is ability to collect compensation for you injuries, doesn’t mean they are just going to write you a check. As with all insurance companies, they are going to put up a fight. They want to pay you the least amount of money as possible to settle the claim. It is very important that you enlist the help of a qualified attorney that specializes in personal injury law. An attorney will not only guide you through the process, but will also help to ensure that you get the full value of your claim.
